The ‘socially valuable knowledge’ principle has been widely acknowledged as one of the most important guiding principles for biomedical research involving human subjects. The principle states that the potential of producing socially valuable knowledge is a necessary requirement, although not sufficient, for the ethical conduct of research projects. This is due to the assumption that the social value of knowledge avoids exploitation of research subjects and justifies the use of health resources. However, more recently, several authors have started interrogating the (...) validity of SVK in research and offered various lines of argument against the SVK principle as a necessary constraint to research. In this article, I will reconstruct the main arguments of this discussion between defenders and debunkers of the SVK principle and offer a third way to consider the social value of knowledge in research studies. I will argue that the social value of knowledge can be supported by an independent justification. This justification of the SVK principle addresses the rationality and common interest of researchers. Thus, I will introduce the SVK principle as a safeguarding principle for public trust based on a conceptual framework by Alex John London. My approach justifies keeping the principle as a precautionary and rational requirement for human health research that all rational stakeholders can agree upon. (shrink)

Mexico's pandemic management and the absence of measures have been harshly criticized as being disproportionate. This paper examines whether the proportionality principle was properly applied to Mexico's COVID-19 response and outlines three reasons against such an endeavor, namely (i) the content of “proportionate measures” remained insufficiently well defined, (ii) there were yet fundamental rights conflicts to resolve, and (iii) the situation was moreover characterized by epistemic uncertainty.

This article discusses whether the current strategies, most notably, vaccine donations by the international community and the COVID-19 global access facility COVAX, offer meaningful solutions to tackle the problem. At the centre of our analysis, we compare the concepts of (...) “donations” and “charity” with “vaccine equity” and the “empowerment” of poorer countries. We suggest that the achievement of fair global vaccine production requires that our global approach is supportive of the idea of empowerment. The writer responds to the article “The Social Value Requirement in Research: From the Transactional to the Basic Structure Model of Stakeholder Obligations,” by Danielle M. Wenner, in the January‐February 2019 issue of the Hastings Center Report.

The term “innovation” or “innovative care” has recently gained attention in the context of the use of novel and not yet fully validated medical interventions and technologies. Most notably, there have been various incidences of medical activities insufficiently validated for its regular use in healthcare that fall into this category, such as stem cell treatments, genome sequencing for diagnostic purposes, or novel reproductive technologies. Latin American countries are among the places where new and non-validated medical activities take place, notably due (...) to a lack of clear regulations and the poor support of authorities of existent legal and ethical guidelines, which is driven by “hidden battles” on the moral status of certain interventions. The increasing importance of innovative care underlines the importance of developing a general framework for these practices. Therefore, the present chapter scrutinizes this nascent field of inquiry in Latin America and offers a conceptual framework for innovation as well as its ethical justification. As we will argue, an important use of the term “innovation” or “innovative care” is best interpreted as “new non-validated practice” and not as a research activity. Then, we will defend that responsible innovation understood as responsible new non-validated practice is ethically permissible and poses an acceptable medical option if done in exceptional circumstances—where no reasonable alternatives can be provided to an individual patient—and following special ethical principles. Finally, we focus on the peculiarities and specific difficulties the concept of new non-validated practice poses to the Latin American context. We will conclude the chapter by some remarks and recommendations we draw from our analysis for individual patients, doctors, and societies in Latin America. (shrink)

Equal access to vaccines has been one of the key ethical challenges during the COVID-19 pandemic. Most scholars consider the massive purchase and hoarding of vaccines by high-income countries, especially at the beginning of the pandemic, to be unjust towards the vulnerable living in low-income countries. A recent proposal by Andreas Albertsen of a vaccine tax has been put forward to remedy this problem. Under such a scheme, high-income countries would pay a contribution, conceptualised as a vaccine tax, dedicated to (...) buying vaccines and distributing them to low and middle-income countries. Proceeding from this proposal, we critically assess the feasibility of a vaccine tax and suggest how to conceptualise and implement a vaccine tax in practice. We present our ‘VaxTax model’ and explore its comparative advantages and disadvantages while considering other possible measures to address the global vaccine access problem, also in view of future pandemics and disease outbreaks. En este proceso, es importante visibilizar los cuestionamientos éticos que pueden surgir por lo que este trabajo pretende dar importancia al tema de la exposición de circunstancias, hechos y cifras dentro de esta problemática y plantear las cuestiones normativas pertinentes dentro de este contexto. Beck uses the term `subpolitics' to refer to forms of politics outside and beyond the representative institutions of the political system of nation-states. From the perspective of the theory of reflexive modernization, the proliferation of subpolitics indicates a weakening of the `iron cage' of bureaucratic, state-oriented politics. We argue that subpolitics does indeed challenge conventional notions of politics. It mobilizes sources of societal influence that transcend the formal political system. In particular, subpolitics correlates with the command over positive or negative (...) sanctions and the capacity for uncertainty absorption. This can be illustrated in the areas of scientific expertise, corporate decision-making and political consumption. Those cases show that the political system cannot monopolize the means of societal influence. For a political system that regards itself as the centre of society, this must be irritating. For sociology, however, it provides the opportunity to part with such an inappropriate account of the role of politics in modern society. (shrink)

Within Kant’s own writings, it is complicated by the further tension between his pedagogy and his moral philosophy. When one sees Kant’s conception of character as a systematic connection between these three aspects of his philosophy, light is shed on the role and limits of the pedagogical function of the republican constitution. Thereby, too, the inherent limit of the extent to which perpetual peace, practically defined, can be a political goal effected by political means is unveiled.

While deep brain stimulation (DBS) for patients with Parkinson's disease has typically raised ethical questions about autonomy, accountability and personal identity, recent research indicates that we need to begin taking into account issues surrounding the patients’ feelings of authenticity and alienation as well. In order to bring out the relevance of this dimension to ethical considerations of DBS, I analyse a recent case study of a Dutch patient who, as a result of DBS, faced a dilemma between autonomy and authenticity. Felicitas Munzel challenges this reading of Kant's thought, claiming not only that Kant has a very rich notion of moral character, but also that it is a conception of systematic importance for his thought, linking the formal moral with the critical, aesthetic, anthropological, and biological aspects of his philosophy. The (...) first book to focus on character formation in Kant's moral philosophy, it builds on important recent work on Kant's aesthetics and anthropology, and brings these to bear on moral issues. Munzel traces Kant's multifaceted definition of character through the broad range of his writings, and then explores the structure of character, its actual exercise in the world, and its cultivation. This article deals with the euthanasia debate in light of new life-sustaining technologies such as the left ventricular assist device (LVAD). The question arises: does the switching off of a LVAD by a doctor upon the request of a patient amount to active or passive euthanasia, i.e. to ‘killing’ or to ‘letting die’? The answer hinges on whether the device is to be regarded as a proper part of the patient's body or as something external. We usually regard the switching (...) off of an internal device as killing, whereas the deactivation of an external device is seen as ‘letting die’. The case is notoriously difficult to decide for hybrid devices such as LVADs, which are partly inside and partly outside the patient's body. Additionally, on a methodological level, I will argue that the ‘ontological’ arguments from analogy given for both sides are problematic. Given the impasse facing the ontological arguments, complementary phenomenological arguments deserve closer inspection. In particular, we should consider whether phenomenologically the LVAD is perceived as a body part or as an external device. I will support the thesis that the deactivation of a LVAD is to be regarded as passive euthanasia if the device is not perceived by the patient as a part of the body proper. (shrink)

The study is carried out in five chapters, with the first two offering a reconsideration of the function of the imagination in the Transcendental Deduction and Schematism of the first Critique. The last three follow the order of topics discussed by Kant in the third Critique in regard to judgments of taste, the sublime, and teleology; they conclude with an interpretation of "productive imagination" as a "model for the ideal of intellectual intuition". The comparison between "human and divine spontaneity" is (...) introduced in the first chapter, where Gibbons notes that while we have "Kant's explicit and repeated emphasis on the difference" between these, "in considering the similarity of these types of spontaneity," she wishes "to correct a possible imbalance in Kant's exposition": there are, she suggests, "formal similarities between these types of spontaneity". The main thrust of the first chapter is to respond to a particular reading of Kant—namely, to those unsympathetic interpreters who see in the Deductions an "imaginary subject of transcendental psychology" and also to those who give a "sympathetic reading" but do so in terms of an identification of "all aspects of synthesis with concept application," thereby reducing the "role of the transcendental synthesis of the imagination to that of unifying a manifold of intuition under a concept". Gibbons holds instead that the "theory of synthesis... focuses on the nature of human cognition and what is required for us to know anything about objects" and, further, that it presupposes "the broader function of the imagination as grounding the possibility of concept-application in the first place". Student sex work is a current phenomenon all over the world, increasingly reported by the media in recent years. However, student sex work remains under-researched in Germany and is lacking direct first-hand reports from the people involved. Further, sex work remains stigmatized, and therefore, students practicing it could be at risk of social isolation and emotional or physical danger. Therefore, this study examines students working in the sex industry focusing on their personal experiences and attitudes toward them. An online questionnaire (...) was completed by 4386 students from Berlin universities. Students who identified themselves as sex workers were questioned with respect to their motivations to enter the sex industry, characteristics of their job, feelings after the intercourse, and perceived risks. Student non-sex workers were questioned regarding knowledge of and attitudes toward student sex workers. Most student sex workers reported that they entered the sex industry due to financial reasons. The majority reported offering services involving direct sexual intercourse. Disclosing their job to friends, family, or others was associated with less problems with social isolation and in romantic relationships. With a total of 22.9%, student non-sex workers reported never having heard about students working in the sex industry. The most frequent emotions mentioned by them with regard to student sex workers were compassion and dismay. There was no difference in happiness between student sex workers and non-sex working students. Through this research, it becomes evident that there are similarities between the student’s motivations to enter the sex industry, their feelings, and the problems they have to face. Moreover, prejudices still prevail about the life of student sex workers. Increasing understanding of student sex work might help those sex workers to live a less stigmatized life and thereby to make use of support from others. The universities as institutions could form the basis for this, e.g., by openly supporting student sex workers. This could help to encourage the rights of student sex workers and to gain perspective with respect to the sex industry. (shrink)

Studies in adults with mental disorders suggest that the experience of early and chronic trauma is associated with changes in reward expectancy and processing. In addition, severe childhood trauma has been shown to contribute to the development of mental disorders in general. Data on effects of early childhood trauma on reward expectancy and processing in middle childhood currently appear insufficient. The present study aims to fill this research gap by examining the effects of developmental trauma disorder on reward expectancy and (...) processing in children aged 8–12 years, testing the hypothesis that children with multiple complex traumas exhibit altered reward processing as a result of prior disappointing reward experiences. One main feature of developmental trauma disorder is early experiences of multiple separation from important and close relationships alongside other experiences of emotional or physical harm. In the sequel children often show affect regulation disorders. To investigate this, we have developed an adapted version of the Monetary Incentive Delay Task, which examines children’s expectation of reward or frustration. In this first study, behavioral data will be collected from N = 40 children using this adapted version of the MID Task. Children in the experimental group will be recruited from youth welfare centers in Frankfurt a.M., Germany. Healthy control subjects will be recruited from after-school-care facilities. A brief trauma screening will be conducted for both groups, experimental and control. If children show signs of trauma, the presence of a developmental trauma disorder will be further delineated by a German translation of the Developmental Trauma Disorder Structured Interview for Children which was translated the first time in German by our research group. We hypothesize that children in the experimental group will be less accurate in performing the Monetary Incentive Delay Task because of their impaired emotion regulation skills due to emotional avoidance following developmental trauma. If the results of our initial behavioral study are promising, the MID task will be used in a future study to elucidate the relationship between trauma developmental disorder, reward expectancy and processing, and neurobiological processes in middle childhood. In this discussion, attention is focused on the neurophysiological changes recorded in the laboratory during experiences termed religious, since they facilitate contact with the alternate, the sacred reality. The experiences examined are "ritual body posture and ecstatic trance" and "channeling," that is possession. Contrary to previously held opinion based solely on observation, laboratory tests reveal certain differences, indicating that we are dealing with two distinct, albeit closely related, ASC's. Impaired performance in verbal fluency tasks is a frequent observation in Parkinson’s disease. As to the nature of the underlying cognitive deficit, it is commonly attributed to a frontal-type dysexecutive syndrome due to nigrostriatal dopamine depletion. Whereas dopaminergic medication typically improves VF performance in PD, e.g., by ameliorating impaired lexical switching, its effect on semantic network activation is unclear. Data from priming studies suggest that dopamine causes a faster decay of semantic activation spread. The aim of the current study was (...) to examine the impact of dopaminergic medication on the dynamic change of word frequency during VF performance as a measure of semantic spreading activation. To this end, we performed a median split analysis of word frequency during phonemic and semantic VF task performance in a PD group tested while receiving dopaminergic medication as well as after drug withdrawal, and in a sample of age-matched healthy volunteers. Dopaminergic medication in the PD group significantly affected phonemic VF with improved word production as well as increased error-rates. The expected decrease of word frequency during VF task performance was significantly smaller in the PD group ON medication than in healthy volunteers across semantic and phonemic VF. No significant group-difference emerged between controls and the PD group in the OFF condition. The comparison between both treatment conditions within the PD group did not reach statistical significance. The observed pattern of results indicates a faster decay of semantic network activation during lexical access in PD patients on dopaminergic medication. In view of improved word generation, this finding is consistent with a concept of more focused neural activity by an increased signal-to-noise ratio due to dopaminergic neuromodulation. However, the effect of dopaminergic stimulation on VF output suggests a trade-off between these beneficial effects and increased error-rates. (shrink)

Several investigations have shown language impairments following electrode implantation surgery for Deep Brain Stimulation (DBS) in movement disorders. The impact of the actual stimulation, however, differs between DBS targets with further deterioration in formal language tests induced by thalamic DBS in contrast to subtle improvement observed in subthalamic DBS. Here, we studied speech samples from interviews with participants treated with DBS of the thalamic ventral intermediate nucleus (VIM) for essential tremor (ET), or the subthalamic nucleus (STN) for Parkinson’s disease (PD), (...) and healthy volunteers (eachn= 13). We analyzed word frequency and the use of open and closed class words. Active DBS increased word frequency in case of VIM, but not STN stimulation. Further, relative to controls, both DBS groups produced fewer open class words. Whereas VIM DBS further decreased the proportion of open class words, it was increased by STN DBS. Thus, VIM DBS favors the use of relatively common words in spontaneous language, compatible with the idea of lexical simplification under thalamic stimulation. The absence or even partial reversal of these effects in patients receiving STN DBS is of interest with respect to biolinguistic concepts suggesting dichotomous thalamic vs. basal ganglia roles in language processing. The thesis provides the first systematic study of Denkungsart as a central conception of Immanuel Kant's philosophy. It argues that this notion, together with the intrinsically related terms, Gesinnung and Vernunftglaube , constitutes the connecting thread of Kant's thought, one that establishes that Kant is first and foremost a moral philosopher. On the grounds of this central problem of the Kantian corpus--the quest for a morally good Denkungsart--Kant is shown to be a moral philosopher in the Socratic sense of asserting (...) the primacy of practical wisdom and a moral philosopher who faces unflinchingly the problem of evil in its most radical sense as one finds it in the Christian tradition. ;The study provides a new perspective for reading and understanding Kant; it articulates the broader moral framework--the form and content of the morally good Denkungsart--in terms of which Kant's pure moral philosophy and what has come to be called his "virtue ethics" are connected. On the basis of this new perspective for reading Kant, the study seeks to disarm and dissolve many of the stereotypical views of Kant found in the scholarship. ;The study begins with a synoptic presentation of the eighteenth century philosophical dialogue in which the term, Denkungsart, first emerges. Defining this context provides the background for appreciating what is at stake in Kant's inquiry into a morally good Denkungsart and for understanding the formulation which Kant gives to his question. Having outlined how Kant's writings constitute a reply to his philosophical milieu, the study investigates three specific issues in his early philosophical reflections--the distinction of laws of nature and moral law, the "problem of nature," and the problem of freedom for moral good--on the basis of which the moral question of Denkungsart arises for Kant. The articulation of the conception of Denkungsart consists of three parts: the form and matter of the morally good Denkungsart and the analysis of Vernunftglaube as the consummation of the morally good Denkungsart. Son impact touchera directement la fonction régulatrice des langages de la foi, autrement dit du caractère principiel et originaire de cette fonction dévolue aux formules de confessions présentes dans l'écriture néotestamentaire. Il s'agissait en somme (...) de poser et de justifier les principes d'une interprétation dogmatique de l'Ecriture. L'une des questions cruciales alors débattues tournait autour de la signification d'un objet de foi saisissable en énoncés de vérité, objet qui ne pouvait consister en une simple sequela Christi, ou être ramené à une anthropologie existentiale. Une place pour le dogme semblait subsister. Ce processus va déboucher sur une interprétation " extensive " du dogme à laquelle V. Holzer consacre ici l'essentiel de ses analyses. In 1965, Karl Rahner and Karl Lehmann published a documented and systematic study of the relationship between kerygma and dogma, the quintessence of work being done in the field when the Second Vatican council was coming to an end. An initial consensual principle would come out of this work. It was to have a direct impact on the regulating function of the languages of faith, in other words the nature of this function as principle and origin allotted to the formulas of confessions present in New Testament writing. In short, it involved laying down and justifying the principles of a dogmatic interpretation of Scripture. One of the crucial questions debated at the time revolved around the meaning of an object of faith that can be grasped in true statements, an object that could not consist of a mere sequela Christi or be reduced to an existential anthropology. A place for dogma seemed to remain. This process was going to culminate in an "extensive" interpretation of dogma, to which V. Holzer devotes most of his analyses here. (shrink)

Velkley's scholarly interpretation identifies Rousseau as the pivotal figure who is the source both of the modern philosophical effort to achieve "human wholeness" by recovering an "original prediscursive or prerational unity" (an account that is the further source of the distinction between culture and civilization [12]) and of the "bifurcation in the ways to reach such wholeness," the ways of "citizenship" and "natural freedom" (13-14). The essays argue for an "important connection between Rousseau and Heidegger, through Kant and Schelling" (6). [End Page 345]While other thinkers are treated (for example, Pufendorf and Nietzsche), the essays primarily examine the writings of these four thinkers to elucidate "the persistence of a set of problems and a way of questioning" particular to modern philosophy (8).Velkley points out that Rousseau's critique of modern rationality is far more subtle than it is usually read. Granted, "through its introduction of self-reflectiveness into the previously 'innocent' and prereflective human situation," reason is perceived as the "true origin" and not the means for overcoming human ills (53). However, the "prereflective origin is nowhere to be found," it is an "imaginative construction," and it is a "mistake to take at face value any apparent assertion that natural man was merely an animal with only instinct and sensation" (37, 41). Because of his distinctively human awareness of time, natural man, "far from being mere animal," is "the only being whose openness to being exposes him to the nonbeing of death" (48). In short, "some 'bondage' to reason" is inescapable and "Rousseau's various plans for the reform of politics, education, the family, and the philosophical life" should be read as "ways of making the most of that bondage" (33).In the case of Kant, Velkley's emphasis is on the critical effort to resolve the dialectic, to correct the rational self-ignorance "so that the striving of reason for totality will not turn into a nihilistic rejection of reason" (112); or put another way, Rousseau inspires Kant's quid juris question, the issue of the "justification of reason as a whole," specifically the legitimacy of the categories (50-61, 101). Schelling, together with Kant's other Idealist successors, seeks a "greater unity, integration, wholeness, and concreteness than Kant provides" (113). The two main aspects of Schelling's project that Velkley discusses are (1) the discovery of the true human self in nature, the "hidden infinite unconscious self beneath the apparent finite conscious self," a "self whose objectification by the finite categories of discursive reason is quite impossible" and which thus discloses an "infinite contradiction" (115); and (2) the affirmation of the error of earlier philosophizing as belonging "essentially to philosophical inquiry" and being the very "precondition for finding truth" (125). This article offers a critical examination of the travel diaries written by Gershom Scholem (1897–1982), a well-known pioneer scholar of Jewish mysticism and a professor at the Hebrew University of Jerusalem. In 1946, Scholem was sent to Prague on behalf of the Hebrew University to retrieve the Nazi-looted Jewish libraries from Czechoslovakia to Palestine. In recent years, at the same time as a significant rise of scholarly interest in the fate of the plundered Jewish books and manuscripts, Scholem’s accounts have (...) come to serve as a main source of information on the Jewish cultural property in the Bohemian lands. Where most of the currently available studies take his description of the Czechoslovak restitution affairs almost for granted, this article seeks to adopt a more distant approach to these materials, by undertaking a comparison with the documentation produced by the local Jewish bodies and the archival sources of the Czechoslovak authorities responsible for the management of Jewish assets. Zooming in on the encounter between Scholem and the leaders of the Jewish community in Prague, the paper points especially to the multiple misunderstandings that arose between the two parties during his visit. It then explores the difference between his and the Prague protagonists’ perspectives on the Nazi-looted Jewish cultural property. (shrink)

Le Christ devant la raison entend reprendre la question du rapport entre théologie et philosophie sous l'angle inattendu de la christologie dans ses métamorphoses modernes et contemporaines. Le projet paraît ambitieux, mais ici il s'attache à un segment de temps qui correspond à une période que l'on peut qualifier de " seconde modernité ", là où la christologie comme discipline de la théologie tend à se détacher de plus en plus du domaine où l'avait confiné l'apologétique défensive, celui de la (...) preuve, pour s'épanouir en un domaine de signification jusqu'alors inédit et qui porte le nom très précis de Christozentrik : le Christ au centre d'un ordo rerum dont il est la synthèse idéale. Mais le "christocentrisme", né d'une intensification métaphysique en théologie, n'est pas sans ambivalences. Il pourrait mettre à mal la logique de la foi et le paradoxe fondamental qui la soutient et dont la christologie est précisément la forme intelligible. La théologie balthasarienne de l'auto-révélation divine se fonde sur le témoignage de Dieu dans l'histoire , sans se détacher d'une métaphysiquede l'être reçue sous l'aspect du transcendantal «Beau» que manifeste toute figure du monde. La métaphysique balthasarienne se déploie ainsi selon un axe original. Elle rompt d'une part, avec les formes de pensée dites «onto-théologiques», et d'autre part, avec une apologétique des signes. Plus qu'une métaphysique, nous sommes en présence d'une onto-phénoménologie dont les implications trinitaires et christologiques offrent des développements (...) à première vue inattendus, manifestant cependant la cohérence et la spécificité de la distribution trilogique de la grande oeuvre balthasarienne . Le centre que constitue la dramatique trinitaire est quant à lui tributaire d'une source philosophique qui n'est pas sans parenté avec la philosophie de la Révélation de F.W.J. Schelling, òu domine le thème de Dieu «Seigneur de l'Être» et de «mise en réserve» de la Gloire. Cette ultime prérogative de la liberté divine ne s'éclaire que dans le domaine de la christologie de l'obéissance et de la kénose. C'est précisément cette dimension qui fait l'objet de nos analyses. Balthasar a acquis la réputation d'un théologien de la Beauté du divin. C'est en phénoménologue qu'il conçoit l'expérience esthétique : comment réussit-il à en faire le fondement d'une théologie esthétique ? « Dieu par lui-rnême a pris une figure » : telle est l'expression centrale de cette esthétique. Elle est influencée au plan théologique par la conception de la Révélation chez Karl Barth : le croire est corrélatif au voir ; et d'autre part au plan philosophique, par le concept de (...) phénomène chez Martin Heidegger : le phénomène est ce qui se montre soi-même par soi-même. L'Écriture est traitée comme une figure, une image phénoménale, dont la médiation se poursuit dans l'Église pour désigner et attester la figure singulière de révélation qu'est le Christ. La difficulté de l'entreprise est de mettre en œuvre une médiation qui n'aboutisse pas à identifier figure du monde et figure de révélation, mais qui n'empêche pas non plus la manifestation de l'être divin en son apparaître sensible, car le mystère de la beauté consiste dans une telle donation de soi-même. Sur ce terrain, Balthasar prend congé d'Augustin et entre en débat avec Karl Rahner. Mais, dans la chair du Christ, Dieu se dévoile en se voilant suprêmement. La figure accède à sa vérité au prix d'une auto-dissimulation. La chair du Christ doit-elle parvenir à ce degré d'idéalité, finalement se « déhistoriser », pour laisser transparaître la vérité de l'Être qui s'offre en elle à notre perception sensible ? C'est la limite paradoxale d'une esthétique fondamentale qui paraît plus propre à inspirer une attitude confessante qu'à se définir conceptuellement.Balthasar acquired the reputation of a theologian of divine Beauty. It was as a phenomenologist that he conceived the aesthetic experience : how did he succeed in founding an aesthetic theology ? « God, of his own doing, took a countenance » : such is the main expression of this aesthetic. It is influenced on a theological level by the conception of Karl Barth’s Revelation : Believing is correlative to seeing ; and on the philosophical level, by the concept of phenomenon with Martin Heiddegger : the phenomenon is that which shows itself by itself. Writing is treated as a figure, a phenomenal image, of which the mediation is continued in the Church to designate and attest the unique figure of revelation, which is Christ. The problem with the undertaking is to put into effect a mediation that does not conclude in identifying the figure of the world and the figure of revelation. It does not prohibit the manifestation of the divine being in its sensitive apparition, for the mystery of beauty consists in the giving of oneself. In this light, Balthasar leaves Augustine and enters into discussion with Karl Rahner. In the flesh of Christ, however, God unveils himself by completely hiding himself. The figure approaches its truth at the price of a self-concealment. Must the flesh of Christ come to such a degree of idealization, finally to de-historicize itself, in order to allow the truth of Being to shine through, a truth that offers itself through that flesh to our sensitive perception ? This is the paradoxical limit of a fundamental aesthetic that seems to be more proper to inspire a confessing attitude than to define itself conceptually. (shrink)

The appearance of a commentary on Kant's Anthropology is very timely, indeed indispensable, given the advent of a new phase in Kant scholarship, attentive to the writings surrounding the main critical texts as (...) a way of gaining a more comprehensive understanding of his thought. This new approach has been partly precipitated by the 1997 release of Volume 25 of the Academy edition containing the student transcriptions of Kant's anthropology lectures spanning a period of twenty-four years. The Anthropology is especially important for understanding Kant's moral philosophy. From 1773 forward, Kant himself never taught morality without concurrently offering his course in anthropology. His own students were thus cognizant of Kant's conception of human nature. Yet during the last 200 years few have paid attention to what sort of being, in Kant's view, was called upon to fulfill the moral vocation. As Brandt points out, the Anthropology has previously provoked no notable study, no discussion among either advocates or detractors.The precise nature of the relation between the Anthropology and Kant's critical philosophy remains an open question. Brandt himself is skeptical about the importance of the Anthropology for moral philosophy. He argues against seeing an integrated relation between the Anthropology and the critical system. For Brandt, the two stand alongside each other. The pragmatic anthropology serves merely as an "encyclopedia of the Kantian philosophy on an empirical level," providing an empirical discussion of its problems (8). He also argues that the pragmatic anthropology is neither identical with the anthropology required as a discipline supplementary to pure moral philosophy (14) [End Page 149] nor with the transcendental anthropology providing the self-knowledge of understanding reason (17). The seeming hallmarks of Kant's thought, such as the triadic structure of cognition, feeling, and desire, are simply an omnipresent "psychological division of European cultural history" (99-100) and so unpersuasive as evidence for a systematic connection of the texts. Anthropology has no "idea of reason" as its "basis." It begins in empirical psychology (especially Baumgarten's) and in Kant's effort to separate it from this discipline as a distinct, "pragmatic discipline" with the goal of "facilitating the prudent action of future world citizens" (9, 11). Brandt's interpretation probably influences his selection of passages from the critical philosophy referenced in his Kommentar.The commentary sets Kant's Anthropology in the historical context of Western thought, identifying related passages in texts which Kant is known to have read, as well as materials unfamiliar to him, but still pertinent for a given theme. Over 400 primary sources (from Homer and the philosophers of antiquity, to such recent writers as Richard Rorty) are referenced, as well as over 300 authors in the secondary literature. The commentary is critical, including in its textual analysis differences between the 1798 and 1800 published editions of the Anthropology, and comparisons with the manuscript in Kant's own hand (now located in Rostock). Marginalia are noted, and in some cases passages struck from Kant's manuscript are reproduced in the Kommentar; one such particularly long passage pertains to Kant's discussion of sensibility as contrasted with the understanding (175-181). Parallel passages are identified in Kant's other writings, including his published works, Reflexionen, correspondence, and other lecture notes. These include references to the anthropology lecture notes compiled in Volume 25, thus making the commentary helpful for someone investigating shifts and developments in Kant's treatment of a given topic. The historical context is also quite helpful for understanding the very concepts of "anthropology" (49-63), "pragmatic" (53), and "application" (57). “THE ONLY THING NECESSARY IS NOT THEORETICAL LEARNING, but the Bildung of human beings, both in regard to their talents and their character.” Kant’s epigrammatic observation in his 1778 letter to Christian Wolke, director of the Philanthropin, adumbrates not only his mature sense of “enlightenment” but also the pedagogical role of his critical philosophy and his own life’s work. Over a decade earlier, his reading of Rousseau’s Emile: or, On Education had “set him straight” about what constitutes the true dignity (...) of humanity, namely, that it did not consist in the advance of knowledge by scholarly inquiry as he had believed. The primary thing was, instead, the “restoration of the rights of humanity,” an objective articulated in Kant’s mature moral thought as that pedagogical method which facilitates the self-consciousness and efficacy of the moral law in the individual. In another 1778 letter, this time to his former student, Marcus Herz, Kant states that the “main purpose of his academic life,” which he “at all times keeps before him,” is to “cultivate good characters.” In both his lectures on anthropology and on pedagogy, Kant repeatedly emphasizes the need for education and, by extension, for attending to the education of the educator. Human beings are nothing save what education makes of them, but they can only be educated by other human beings who must themselves first be educated. As early as his 1775/ 76 anthropology lectures, Kant observes that “if teachers and priests were educated, if the concepts of pure morality would prevail among them, then... the whole could afterwards be educated.” The resulting task is clear: it is incumbent on every generation to work on the plan of a more purposive education,” a task Kant describes as the “greatest and most difficult problem that can be assigned to humankind.”. In this roundtable discussion, early-career researchers working in the field of law, gender, and sexuality discuss international and trans-national developments to legal gender. ‘The Future of Legal Gender’ research project focused on the legislative framework of England and Wales to develop a prototype for decertification. The domestic legislation, however, was situated within a wider international context throughout the project. This roundtable discussion, therefore, provided an opportunity for reflection on the transnational issues raised by decertification, with a particular focus on developments (...) arising in the jurisdiction(s) studied by the early career researchers. The roundtable began with a brief outline of these recent developments before moving to an open discussion on key themes including the value of reform on wider society, changes on-the-ground by non-state actors, and alternative processes for tackling gender inequalities without certifying legal gender. The online conversation took place on 28 June 2021 and has been transcribed and edited for continuity, clarity, and referencing. (shrink)
